Abstract

The Government of Puerto Rico is interested in dealing with family conflicts through non-adversative processes. The Senator Bill 63 (2009) purposed to consider joint-custody as the first option in child custody disputes. This Bill suggests a modification of the policy that says how to deal this type of cases. The Bill supports the use of mediation in those cases where one of the parents do not wants joint-custody. It also adds emotional management and educational workshops for parents (Santana, 2010). This makes a cali to forensic social workers to investigate and Illustrate the Judicial Branch of Puerto Rico on the variables to be considered. Examining parental attitudes, as a variable, before beginning a child custody process is the key to divert custody cases through mediation. Parental attitudes prolong child custody processes and it opens a path to commit different types of allegations. For example, the rejection of a child to be with one of the parents is just one of the allegations heard by family courts. This article is a proposal to deal with child custody cases utilizing parent education and mediation; seeking to justify based on research changes in policies that governs these processes.
