Abstract
Today there are many claims for damages. Torts Law has reached great importance by the countless risks of our modern life. Our legal system has the duty of protecting people from harm. Under this statement, today we have a new social and cultural philosophy: any damage must be compensated. In the light of this reality, the idea of who should assume the harmful consequences has evolved. The old axiom that there is no-fault liability has been abandoned and a new principle has been adopted: there is no responsibility without damage. The liability is not based on the wrongful act, but on the damage itself.
